MONARCH MOUNTAIN SEASON PASS AGREEMENT

Season Pass holders agree and understand that skiing and snowboarding can be hazardous.  The Colorado Legislature, recognizing the dangers and risks inherent to the sport, has amended the Skier Safety Act to provide as follows:

Under Colorado Law a skier/snowboarder assumes the risk of any injury to person or property resulting from any of the inherent dangers or risks of skiing/snowboarding and may not recover from the ski area or any ski area personnel, it's subsidiaries, or the National Forest Service for any injury resulting from any of the inherent dangers or risks of skiing/snowboarding, including:  changing weather conditions, bare spots, rocks, stumps, trees, collisions with natural objects,  variations in terrain and the failure of skiers/snowboarders to ski/snowboard within their own abilities. The holder realizes that falls and collisins do occur and injuries may result, and therefore per Colorado law the skier/snowboarder assumes responsibility at all times. "The Ski Safety Act was amended in 2004 to include CLIFFS, EXTREME TERRAIN, TREES, JUMPS AND FREESTYLE TERRAIN as inherent dangers and risks of the sport.

Monarch Mountain reserves the right to revoke any Season Pass if the pass holder does not conform to the rules and regulations of the Colorado Skier Act/Senate Bill 80.

Pass holders must be aware that snowmaking and snow grooming may be in progress.  Ski area personnel may revoke this pass if, in his/her sole judgment, the holder has engaged in improper conduct, including committing an act which endangers holder or others, or any act which constitutes as a nuisance.

Season Passes are NOT REFUNDABLE, except in the case of a major injury or illness, which is documented by a physician.  Monarch will refund monies for Season Passes ONLY for medical reasons which would prevent the pass holder from skiing/snowboarding for the remainder of the season.  Requests for refunds must be accompanied by a written medical diagnosis, signed by the attending physician.  The amount refunded will be prorated based on usage, less a $50.00 processing fee for each pass refunded.  No refunds will be granted for medical reasons after MARCH 1st of the current season. 

Pass holders providing ski or snowboard lessons or related services for compensation will forfeit season rights and privileges

Season Passes will be used ONLY by the person it is assigned.  Passes are NOT TRANSFERABLE AND CAN NOT BE RESOLD to another person.  Use by anyone other than the assigned passholder constitutes fraud and will result in revocation of the pass and privileges WITHOUT refund and may result in fines of up to $1500.00.

Loss or theft of the Season Pass must be reported to the Monarch Season Pass Office immediately.

The replacement cost for a lost, stolen or broken pass is $20.00.

Failure to bring the Season Pass to the ski area may result in the purchase of a daily lift ticket at full Ticket Window price.

Season Pass holders will wear their pass on the OUTSIDE of their clothing.  The pass will be shown at all lift locations and will be visible to all  Monarch personnel.  Season passes may be revoked by Monarch Mountain, without refund, if the passholder fails to comply with the terms and conditions of this agreement.  Season Passes may also be revoked, without refund, if the pass holders conduct or activities are deemed inappropriate by Monarch Mountain.  I ACKNOWLEDGE THAT I HAVE READ, UNDERSTAND AND AGREE TO THESE TERMS, RULES AND CONDITIONS.
